FCC Eliminates “In Market” Roaming Exception; Seeks Comment On Data Roaming

In a huge reversal of its 2007 roaming order adopted under former FCC Chairman Kevin Martin, the Genachowski FCC has eliminated the home roaming exception and adopted a presumption in favor of fair roaming practices. Any CMRS carrier that is effectively denied roaming because of onerous terms and conditions has recourse. Next up, the FCC will determine whether to adopt mandatory automatic data roaming rules – an absolute must for rural carriers.
